1. About these Terms

This website is operated by Dawson Watches Ltd (“Dawson Watches”, “we”, “us” or “our”).

These Terms of Service (“Terms”) apply when you:

  • Visit or use dawsonwatches.com.au;

  • Create an account;

  • Purchase products from us; or

  • Use any other service we provide through the website.

By using the website or placing an order, you agree to these Terms and the policies incorporated into them, including our Privacy Policy, Shipping Policy and Returns and Refunds Policy.

If you do not agree with these Terms, you should not use the website.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a contract to place an order.

If you are under 18, you may only use the website or place an order with the involvement and permission of a parent or legal guardian.

You must provide accurate, current and complete information when creating an account or placing an order.

3. Website use

You may use this website only for lawful, personal and non-commercial purposes.

You must not:

  • Use the website for an unlawful or fraudulent purpose;

  • Attempt to gain unauthorised access to the website, customer accounts or connected systems;

  • Introduce viruses, malicious code or other harmful material;

  • Interfere with the operation, security or availability of the website;

  • Scrape, harvest or collect information from the website using automated means without our written permission;

  • Impersonate another person or provide false information;

  • Infringe intellectual property, privacy or other legal rights;

  • Use the website to distribute spam or unsolicited communications;

  • Place orders for unauthorised resale or other commercial purposes; or

  • Circumvent purchase limits, security controls or fraud-prevention measures.

We may suspend or restrict access where we reasonably believe these Terms have been breached or the website is being misused.

4. Products and availability

We make reasonable efforts to ensure product descriptions, photographs, specifications, prices and availability information are accurate.

Product colours and appearance may vary slightly because of lighting, photography and device-display settings. Packaging may also differ from images shown where a manufacturer updates its packaging.

All products are subject to availability. Adding an item to your cart does not reserve it.

We may limit the quantity of a product available to any person, household, address or order where reasonably necessary, including to manage limited stock or prevent unauthorised resale.

5. Suppliers and fulfilment partners

Some products may be supplied, stored or dispatched with assistance from third-party suppliers and fulfilment partners.

An order may be shipped directly from a supplier or another authorised dispatch location. We may provide the relevant supplier, fulfilment partner or carrier with the information reasonably required to process and deliver your order.

Dawson Watches remains responsible for the sale to you and for addressing your rights against us under the Australian Consumer Law.

6. Prices and taxes

Unless otherwise stated:

  • Prices displayed on the Australian website are in Australian dollars;

  • Prices include Australian Goods and Services Tax where applicable; and

  • Delivery charges, if any, are displayed at checkout.

Prices, promotions and product availability may change without notice before an order is accepted.

A price change will not affect an order we have already accepted, unless you agree to the change or there was an obvious pricing error.

For international orders, you may be responsible for customs duties, import taxes and other charges imposed by the destination country.

7. Orders and contract formation

When you place an order, you are making an offer to purchase the selected products under these Terms.

Receiving an automated order-confirmation email means we have received your order. It does not necessarily mean that we have accepted it.

A contract for the sale of a product is formed when we confirm acceptance of the order or dispatch the product, whichever occurs first.

We may review an order before accepting it for reasons including product availability, pricing errors, payment authorisation, suspected fraud, purchase limits or delivery restrictions.

If we cannot accept all or part of your order, we will notify you and refund any payment taken for the affected product.

8. Errors and order cancellation

Occasionally, product, pricing, promotion, stock, delivery or other website information may contain an error.

Where an error is obvious and we have not accepted the order, we may correct the error and ask whether you wish to proceed at the correct price or on the correct terms.

If we cannot supply a product, or if an order is affected by an obvious error, suspected fraud or an unauthorised transaction, we may cancel the affected part of the order and issue a refund.

Nothing in this section limits any rights you may have where we have already entered into a binding contract or where the Australian Consumer Law applies.

9. Payment

You must pay the total amount shown at checkout using an accepted payment method.

Payments may be processed by Shopify or third-party payment providers such as PayPal, Afterpay or another provider selected during checkout. Your use of a third-party payment service may also be subject to that provider’s terms and privacy policy.

We do not generally receive or store your complete payment-card details.

You confirm that you are authorised to use the payment method provided. We may delay or cancel an order if payment is declined, reversed or identified as potentially unauthorised or fraudulent.

Buy-now-pay-later arrangements are agreements between you and the relevant payment provider. Repayment obligations, fees and eligibility requirements are governed by that provider’s terms.

10. Promotions and discount codes

Promotions and discount codes are subject to any conditions displayed with the offer.

Unless otherwise stated:

  • Discount codes cannot be exchanged for cash;

  • Only one discount code may be used per order;

  • Codes must be applied before checkout is completed;

  • Codes cannot be applied retrospectively;

  • Promotions are subject to availability and stated closing dates; and

  • Discount codes may exclude particular products, brands or collections.

We may cancel or refuse a promotion where it has expired, been used contrary to its conditions or been affected by fraud, misuse or an obvious error.

Your rights under the Australian Consumer Law apply equally to products purchased during a sale or promotion.

11. Shipping and delivery

Orders are generally processed within 1–3 business days. Once dispatched, delivery usually takes approximately 2–6 business days, depending on your location and the carrier used.

Delivery timeframes are estimates unless we expressly agree to a guaranteed delivery date.

Weekends, public holidays, remote-area requirements, carrier disruptions, customs processes and circumstances outside our reasonable control may affect delivery.

You must provide a complete and accurate delivery address. Please contact us promptly if you notice an error. We cannot guarantee that an address can be changed after an order enters processing or is dispatched.

12. Risk and ownership

Ownership of a product passes to you once we have received full payment for it.

Responsibility for loss or damage passes to you when the product is delivered to you or a person authorised to receive it on your behalf, except where the law provides otherwise.

If you authorise a carrier to leave a parcel unattended, responsibility may pass when the parcel is delivered in accordance with that authority.

13. Returns, exchanges and refunds

Our Returns and Refunds Policy forms part of these Terms.

Change-of-mind returns and exchanges may be requested within 30 days of delivery, subject to the eligibility requirements and return-authorisation process in that policy.

An AUD $60 restocking fee applies to approved change-of-mind returns and exchanges. The customer is responsible for the applicable return shipping costs.

Different rules apply to faulty, damaged, incorrectly supplied or misdescribed products. Nothing in our voluntary change-of-mind policy limits your rights under the Australian Consumer Law.

Do not return an item without first obtaining return authorisation and the correct return address from Dawson Watches.

14. Consumer guarantees

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

You may be entitled to a repair, replacement, refund, compensation or another remedy if a product:

  • Is faulty;

  • Is unsafe;

  • Is not of acceptable quality;

  • Does not match its description;

  • Is not fit for its normal purpose or a purpose made known to us; or

  • Otherwise fails to meet an applicable consumer guarantee.

The appropriate remedy depends on the circumstances and whether the failure is major or minor.

Any manufacturer’s warranty or Dawson Watches warranty operates in addition to, and does not replace, your rights under the Australian Consumer Law.

15. Authenticity and manufacturer information

We aim to supply genuine products sourced through suppliers and commercial channels we consider reputable.

Product packaging, manuals, warranty documentation and authorised service arrangements may vary between brands, suppliers and markets.

References to brands, manufacturers and trademarks are used to identify the products offered for sale. Unless expressly stated, such references do not imply that Dawson Watches is owned, operated or endorsed by the relevant brand.

Any separate authenticity or warranty representations published on our website form part of the product information applicable to your purchase.

16. Accounts

You are responsible for:

  • Keeping your account information accurate;

  • Maintaining the confidentiality of your password;

  • Restricting access to your account and devices; and

  • Notifying us promptly of suspected unauthorised access.

You are responsible for activity conducted through your account to the extent permitted by law.

We may suspend or close an account where reasonably necessary to protect customers, prevent fraud, enforce these Terms or comply with legal obligations.

17. Intellectual property

The website and its content—including text, graphics, branding, logos, photographs, layouts, software and other materials—are owned by or licensed to Dawson Watches and are protected by intellectual-property laws.

You may view and use the website for personal shopping purposes.

You must not reproduce, modify, distribute, publish, commercially exploit or create derivative works from website content without our written permission, except where permitted by law.

Third-party trademarks and product images remain the property of their respective owners.

18. Reviews, feedback and other submissions

If you submit a review, photograph, comment or other content to us, you confirm that:

  • You created it or have permission to submit it;

  • It is accurate and not misleading;

  • It does not infringe another person’s rights;

  • It is not defamatory, unlawful, threatening or offensive; and

  • It does not contain malicious code or undisclosed promotional material.

You grant Dawson Watches a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit, publish and display submitted content for operating, promoting and improving our business.

This licence does not transfer ownership of your content to us. Our handling of personal information contained in a submission is governed by our Privacy Policy.

We may moderate or remove content that breaches these Terms or applicable law.

19. Third-party services and links

The website may contain links to or integrations with services operated by third parties.

We do not control third-party websites and are not responsible for their availability, content, security or privacy practices.

Your use of a third-party service is governed by that party’s terms. You should review those terms before using the service.

20. Privacy

Our collection, use, storage and disclosure of personal information are explained in our Privacy Policy.

By using the website, you acknowledge that personal information may be processed by Shopify, payment providers, suppliers, fulfilment partners, delivery providers and other service providers as reasonably required to operate the store and fulfil orders.

21. Website availability

We aim to keep the website accurate, secure and available, but we do not guarantee uninterrupted or error-free access.

We may temporarily suspend, update or modify the website for maintenance, security or operational reasons.

To the extent permitted by law, we are not responsible for loss caused solely by website interruptions or technical problems outside our reasonable control.

22. Liability

Nothing in these Terms excludes, restricts or modifies:

  • The Australian Consumer Law;

  • Liability that cannot lawfully be excluded; or

  • Any mandatory consumer right or remedy.

To the extent permitted by law, Dawson Watches is not liable for indirect or consequential loss that was not reasonably foreseeable and was not caused by our negligence, breach of contract or breach of law.

Where the law permits us to limit a liability relating to services, our liability may be limited, at our option, to supplying the services again or paying the reasonable cost of having the services supplied again.

This section does not limit liability for fraud, wilful misconduct, personal injury caused by negligence or another liability that cannot legally be limited.

23. Your responsibility for loss

To the extent permitted by law, you are responsible for loss reasonably suffered by Dawson Watches as a direct result of your unlawful use of the website, fraud, wilful misconduct or material breach of these Terms.

You are not responsible for loss caused by Dawson Watches, its personnel or a matter outside your reasonable control.

24. Termination

You may stop using the website at any time.

We may suspend or terminate your access if you materially breach these Terms, misuse the website, engage in fraud or threaten the security or operation of the website.

Termination does not affect rights or obligations that arose before termination, including obligations relating to payment, intellectual property, liability and dispute resolution.

25. Changes to these Terms

We may update these Terms to reflect changes to our business, website, services or legal obligations.

Updated Terms will be published on the website with a revised “Last updated” date.

Changes will apply prospectively. The terms applying to an accepted order will generally be those in effect when the order was placed, unless a change is required by law or agreed with you.

26. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down to the extent necessary or severed.

The remaining provisions will continue to operate.

27. No waiver

If we do not immediately enforce a right under these Terms, that does not mean we waive that right.

A waiver is effective only if expressly given.

28. Governing law

These Terms are governed by the laws of Victoria, Australia, and applicable Commonwealth laws.

The parties submit to the courts of Victoria and any courts entitled to hear appeals from those courts.

This section does not prevent you from exercising any right to bring a claim in another jurisdiction where that right cannot lawfully be excluded.
